US Court Orders Freedom of Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. After his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.
In her decision, the judge pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The court proceedings involve disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.

The judge, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
